AN ILKLEY resident has lost an appeal against a decision by Bradford Council to refuse him permission to absorb an area of public land into his garden.

Mr William Scott has twice submitted a planning application to the council to change the use of public highway at the corner at 5 Dale View and Woodland Rise in Ilkley into a private garden.

Both applications were refused after objections were raised by local residents and councillors.

The applicant Mr Scott submitted an appeal to the planning inspectorate against the second decision to refuse his application and he has now lost that appeal.

A site visit was undertaken by an appeal planning officer in October who concluded: “The proposal would have a harmful effect on the character and appearance of the area.”

She said: “...the open space makes a significant contribution to the character of the area by maintaining a sense of openness.” And added: “...the development would erode the openness of the immediate area, causing harm to its character and appearance as a result.”

An application for an award of costs by Mr Scott against Bradford Council was also refused.
