This Notice is not overt to the disposal of Land which is Public Open Space and is required to be clearly advertised under s122 of the LGA ( local Government Act ). The principle substance of the notice is the sale of the Land in position of the Council as a Corporate Trustee of a Charity , meeting the obligations of the Charity Act as such , a charity has no legal grant to exercise the redaction of a Statutory Matter in terms of its use By Right and substantially protected by a Parlaimentary Act ( Wibsey Slack and Low Moor enclosure Act of 1880 ). The Council has therefore failed in its statutory duty to duly advertise or in the alternative incorrectly advertise under the provisions of the charity Act , without provision for requisite tests necessary for decommisioning or apropriating legally the same , and to which any necessary protections would be given consideration under express process for avoidance of doubt this is allegedly my belief.
