A SKIPTON man has been banned from driving for a year following a late night shopping trip to Tesco.

Samuel Hurst, 33, was stopped by police on Craven Street just before midnight on June 10 after being notified by a member of staff that he appeared to be in drink, heard Skipton magistrates.

He provided a positive roadside breath test and was arrested, the court heard.

On his way to Harrogate Police Station he said he was feeling unwell and continued to complain once he had arrived at the station, said prosecutor, Martin Butterworth. He was taken to the hospital to be told there was nothing wrong with him, and returned to the police station.

A breath test, more than two hours later, revealed he had 41 microgrammes of alcohol in 100 millilitres of breath, the legal limit is 35.

Hurst, who admitted drink driving, was likely to lose his job as an engineer, the court heard.

In mitigation, Nicholas Leadbeater said Hurst was currently off sick from work with broken ribs, for which he was taking strong pain killers.

On the day, he had been out with his partner for a meal and had gone to Tesco after drinking a couple of glasses of wine.

In addition to a 12 month driving ban, Hurst, of Milton Street, will have to pay a fine of £403, costs of £85 and surcharge of £40. If he completes a drink drivers rehabilitation course, his ban will be reduced by 12 weeks.
